December 15th is Bill of Rights Day!

Unfortunately, most Americans have no idea that December 15th is Bill of Rights Day. The Bill of Rights separates the United States from any other country as a true republic which guarantees individual liberties which cannot be taken away by the government.

Unfortunately, many Americans believe that the USA is a “democracy” whereby 51% of the people can take away freedoms from 49% of the people. This is simply not true, the USA is a Constitutional Republic that follows democratic principals.

“For the first century of its existence, the Bill of Rights did not appear in many Supreme Court cases, principally because the Court ruled that it only applied to the national government, and the state governments exercised the most power over citizens’ lives,” said Linda Monk, author of “The Bill of Rights: A User’s Guide.”

Shortly after the Civil War, the newly ratified 14th Amendment appeared to require that states honor constitutional liberties, by declaring that “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States.” The Supreme Court again ruled that the Bill of Rights did not apply to states.

 
Like many SCOTUS deviations from the original intent of the Bill of Rights, the previous 10th Amendment says...

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.



So the 1833 SCOTUS Barron v. Baltimore ruling was a bad one.

Better tear down any monuments to Chief Justice John Marshall. :whistle:
