More troubles ahead?

For one thing, the ATF can't make rules and such, thats congress place, but this administration thinks they can do anything they want......it will get struck down like the other stuff they tried.....

Yes they can.

A "Rule" is not a law, only Congress can pass and send a law to the POTUS.

BUT, a "Rule" is what an executive-branch govt agency develops in order to implement a law.

Various administrations take great liberty in directing agencies to develop "rules", under the auspices of an existing law, to further their ideological intentions.

Rules that over-reach a law and/or are deemed un-Constitutional gets struck down

But often it takes years for cases to come before the Supreme Court. In the meantime either house of Congress can change hands or even worse, the President's party can end up in control of Congress.Then there's this idea that the libs have about stacking the Supreme Court. Should any of this happen, gun ownership will take a huge hit in this country.

I think the current cases involving the brace "Rule" will cover this too. Meanwhile it is completely unenforceable. They have the obligation to A) prove you sold it after the date of the rule change and B) you made a profit. Then there's the huge problem of how they would ever find out about the sale in the first place. At best you would have some nervous Nancy's who would be too afraid to sell a gun without following the new rule, but then most of the people here ( they claim anyway) wouldn't sell a gun in a private transaction without one, so probably a moot point all the way around.

The Supreme Court is already stacked and I don’t believe Biden has remotely the juice to restructure the court.

I would disagree that the Court is stacked, especially when we consider the recent rulings handed down regarding abortion and some of the second amendment issues, where their decisions came down on the side of Constitutionalists.

One can certainly argue that at least a couple of the justices (Roberts and Kavanaugh in particular) are likely wild cards when it comes to Originalism, but so far Kavanaugh hasn't strayed too far. The Court certainly has a conservative flavor, but is far from stacked.

As for Biden not having the political juice to pull it off, remember that it will be a group effort rather than an executive acting alone; therefore, we can expect him to have a company of willing participants in that attack on the Republic. Packing the Court is going to be a priority for the Marxist left as they view it as a mechanism to enact their unconstitutional policies and protect their agenda once they get it in place.
