NICS Denial Notifications for local Law Enforcement

"Tucked into the VAWA was a bipartisan measure called the NICS Denial Notification Act, which mandates that the FBI's NICS Section alert state and local law enforcement of all denied attempts to purchase a firearm within 24 hours."

By October 1, 2022, the FBI will be required by law to report National Instant Criminal Background Check (NICS) denied transactions to state, local, or tribal law enforcement within 24 hours.

Illnoise who uses it's own background check has posted more info on thier process.

"This NICS denial notification is for information only; there is no requirement for action to be taken by the agency notified."

The il link has a link to thier notifications that includes an denial overturn notice:

"Denial Overturn Notification Example The following is the denial overturn notification that will be received when the NICS Section determines a person is not prohibited:
*****************************************************************************
NOTICE OF FIREARM DENIAL OVERTURN: A PERSON PURCHASING/RESIDING IN YOUR JURISDICTION WAS PREVIOUSLY DENIED THE TRANSFER OF A HANDGUN AND IS NOT PROHIBITED *****************************************************************************"

Well it’s not just denials. It’s also delays. And not only do they notify local authorities and open an investigation but the 4473 process cannot proceed until the FFL inputs the gun buyers home address into the NICS system.

90% of denials are in error.

I am not a felon or a prohibited person but I am literally delayed every single time. The last 20 guns I bought I had to wait 3 business days to take possession. It’s a pain but whatever. Not worth getting a lawyer or going through all the red tape to sort it out. But now?

I've never been denied but I have been getting delays at the one big gun store 2 hours away that has some great deals. A 1 day delay has been my longest and up to 2 hours sitting in the store waiting a few other times.

My favorite LGS just a few miles away gets my instant check back before I can finish filling out the form, sometimes it seems like a race to see who will be done first. Why the difference? Don't know.

That's interesting. I've bought at several gun stores and shows in the State of Pennsylvania and have never waited more than 5 minutes literally. Some places I've come in and they stated that the wait time for approval is 2-3 hours with several customers waiting before I arrived. I've then purchased a firearm (along with others), and I'm approved (several times before completing the forms), while the others have to wait sometimes hours. At my LGS, we joke that either PA State Police system or ATF have a file on me indicating to approve this guy right away. They also take bets on how fast I'll be approved. :sneaky:

I started buying handguns at the local Academy Sports when I lived in Eagle Pass Texas, I bought 3 at first one at a time over 2 months. Then 3 at once, all my purchases went through with no wait.
During one purchase there was a guy ahead of me that got denied, he had a meltdown, police were called, it wasn’t pretty. After everything calmed down I asked the salesman what are the reasons people get denied, he told me most times it’s a common name, (ie)
(John Smith) that raises a red flag, sometimes it’s just a 3 day wait to confirm information.
Since I got my CCDW in Kentucky my purchases were done with no phone call, I’m sure I was checked out just not at the moment of sale as in the past.

Oh come on fess up, it’s because you’ve given the keys to your multiple vaults to the local Swat Team so they can train with superior weapons that their budgets don’t allow them to buy. 🤦‍♂️😎😵‍💫🤣😂😂

in my state (RI) if one does not have a CCW, then you will wait 8 days before you can take a gun home.

once you get that CCW (like i do), it takes mere minutes and you're out the door. in fact, once you get approval, you can add a "few" more guns to your purchase at that time as well. (and that is for either the 8 day waiting period or those few minutes).

BUT, once you walk out that door..?? and you wanna buy another gun..??

too late, the sale was finalized, and you gotta do the 4473 all over again...... as well as the 8 day wait, or the few minutes.

I'm an FFL and a police chief of my local PD.

Police departments all over the country or short-handed, the last thing they're going to want to do is to open a case. I can guarantee they'll type a simple one paragraph report and call it done.

Plus like you said it's also for delayed responses. As a law enforcement officer, FFL, and CCW instructor the state and feds both have my fingerprints, conducted thorough background checks on me, and have all my personal information. With all that said my last purchase was delayed. You'd think with all the information they have on me it'd be an easy approval but it goes to show that it'll happen to all of us.

*Just to be clear I'm not saying I should receive any special treatment based on my job. I'm just pointing out how much information they all have on me and clearly know I'm not a criminal or forbidden from owning a firearm.

I get all that and I agree. It's just the point of it. Like SBR'ing an AR. I am against it on principle.

I hold a Class A license with X endorsements, which include Hazmat, for which I am fingerprinted and BGC'ed every 5 years. They have all the information you can get on me too. You'd think after 15 or 20 they'd figure it out.
