Thieves shoot at homeowner. Homeowner gets charged.

Well, closing your eyes and shooting at a not clearly defined target is not a good idea, but he was shot at first…
Lots of stuff at play here.
Especially since he was fired upon first on his own porch.
Conversely, his stray rounds could have killed a neighbor sleeping in bed.


 
Never send a boy to do a man's job. Shooting at attackers as they run away with your eyes closed is a marginal activity at best. Might as well have told the police he was shooting at sound. The burden is on the car owner to convince the authorities his life was in danger. In my humble opinion that may be a bridge too far in this case.

once again, as per several videos on self/home defense, NEVER go outside and start shooting.

however, each state IS different in that, this may have been allowed for him to do so..????
 
Well at least he did hit something:
At the scene, deputies said the man's home and his next-door neighbor's home were left with bullet holes.
Two vehicles were also shot and six rounds were found on the hood of a Chevy at the scene, deputies said, indicating gunfire from behind the vehicle.
 
One of the rules of CCW in CA, is that you cannot open fire outside your home to prevent someone from stealing your car. Fortunately for me, all of our cars are in our garage. Otherwise, and I know it would be a PITA, I would trust the insurance company to replace/repair the car. Losing my CCW, my freedom, or worse, my life over a depreciating asset, I’ll pass.

Shooting someone over a car or an inanimate object is murder. This homeowner was likely justified in returning fire, but he shoulda done it when he was actually under threat. And with his eyes open and no innocent people or property in the back drop.

Well it's that way in Missouri and we have all the protections afforded law abiding gun owners anyone else has. Expanded Castle, stand your ground, constitutional carry, pre-emption laws that protect you against civil suits in the case of a justified shooting. It's hard to imagine a place where you were justified for shooting someone fleeing or stealing your property, not in some tangible way threatening you with death or great bodily harm.

I’ve said it before.
I’m not slinging rounds over my car or tires and risk killing a neighbor in their home.
Gives me a reason to get a whole newer model car anyway 😏

I live in Shelby County, Tn and this has been on the local news.
If you're involved in a shooting, you better expect to be arrested. The cops are just covering all the bases. The man has been released on his own recognizance and I seriously doubt if charges will be filled.
