CA Fed judge rules again mag ban, again.

It is a procedural step. If he does not allow for the State's appeal he can be overturned by the higher court later on a procedural error which has nothing to do with the merits of the decision. The state's weasels will exploit any crack, it is best to get it right vs being overturned.
