FEDERAL COURT UPHOLDS STATE 'ASSAULT WEAPON' BAN

The U.S. First Circuit Court of Appeals, based on Boston, upheld the Massachusetts gun ban on popular semi-auto firearms.
The court is one of the most left-leaning in the country, with all six of its active judges appointed by Obama and Biden. Of its five senior judges, only two are Republicans, appointed by G.W. Bush and Nixon, although they rarely hear cases.

The court determined the ban was not unconstitutional under the Second Amendment, ruling that it aligns with the nation's history of firearms regulation.

Elaboration:
  • The Massachusetts Law:
Massachusetts has a law that bans the sale, transfer, or possession of certain semi-automatic rifles, often referred to as assault weapons.

  • The Challenge:
A legal challenge was filed against this law, arguing that it violated the Second Amendment right to bear arms.

  • Federal Court Decision:
The US Court of Appeals for the First Circuit in Boston upheld the state's ban. They ruled that the law was consistent with the nation's history of regulating firearms.

  • Rationale:
The court's decision suggests that the ban on these types of rifles, particularly those used in mass shootings, does not violate the Second Amendment, as it is a judgment that legislatures are allowed to make without second-guessing by the courts.

  • Impact:
This decision has implications for gun rights and the legality of similar bans in other states, as it suggests that state laws restricting certain types of semi-automatic rifles may be upheld in the face of Second Amendment challenges.

Hi,

It boggles my mind how certain states can infringe our 2A rights and others don't. I'd say take it to the Supreme Court but it seems their rulings have been hit-or-miss lately. It shouldn't be necessary but perhaps the majorities in the House and Senate need to pass legislation to enforce the 2nd Amendment.

Thank you for your indulgence,

BassCliff

The industry doesn’t do itself, or gun owners, any favors when the circulate ads like this:

I’m pretty surprised by some of these responses. You’re the same yahoo’s that gripe when politicians and the media refer to AR type weapons as assault rifles, or assault weapons, but your all in with advertising them as a Battle Rifle. SMH!

The term has been used for decades.

A battle rifle is a service rifle chambered to fire a fully powered cartridge.

The FN SCAR 17S is chambered in 7.62x51 which qualifies it as a "Battle Rifle", as per the definition. So....

My conclusion with 3 posts in one year (2 today) = "Both".

#1 - You post a pic that has nothing to do with the OP court case so that qualifies you as a "troll"

#2 - Historicaly you don't understand the commonly-used term "Battle Rifle".

The info in the two links are very easy to understand, but if that info doesn't make sense get someone to explain them to you.

my state legislators will soon vote on a "assault weapons ban", which WILL include ALL semi-automatic guns....ALL hand guns included..!!

this will not work in our favor....for sure.

and given that its been like 3 years now our case is "supposed" to be heard at the Supreme Court, regarding the 10 round magazine ban........we are sunk.

and NOOOOO...i do not vote dumbocrats into office.

so i didn't ask for what i voted for.

DON'T NO ONE HERE SAY THAT TO ME......!!!!!!!!
