To Act Or Not To Act: The Good Samaritan Situation

A question that all good Samaritans should consider is whether they would intervene if a threat were to arise.

When I first started carrying there was this thing that people talked about called the "Sheepdog" concept.

I don't hear it so much anymore but the idea was that simply because you had a concealed handgun permit and you were carrying a gun you had an obligation to respond.

I never bought into it then and I'm not buying into it now. If me or mine are not directly threatened I'm not getting involved.
 
I can't be like that, if i see a woman getting assaulted or anyone that needs help. i'm helpin. i always want to beat the livin hell outta those clowns that film an assault happening and don't help.

Here's some paraphrased advice of his that I find quoted frequently on the internet.

If you are ever involved in a deadly force incident, assuming it goes to trial, the prosecution is going to subpoena all your devices and all your hard drives and all your Internet passwords and all your internet identities.

They're going to go through everything you ever posted on the internet.

He was also very specific about saying that if you don't give them access they can charge you with perjury. I don't understand it exactly but I remember him saying it.

Long story short what he says is that if you've got a gazillion posts on the internet about how you're not going to sit by and watch this happen and you're going to get involved every single one of them is going to be read to the jury and the Prosecution is going to paint you as a vigilante who was just waiting for his chance.
 
I agree with both of you on this, the thing is it is on a case by case basis. If someone is getting dragged into an alley and being assaulted then yes it is not something most of us will walk away from. You also need to remember the consequences of acting and potently getting arrested, accidently hitting a bystander if shooting or even if all else is 100% getting sued in civil court. It also depends where you are because some of these DAs treat us worse then the criminals actually committing the crime we defended against.

I can't stand by and watch someone take advantage of an innocent person. If i go to jail for helping someone in need, so be it.
Have you discussed this with your wife or significant other? Are they prepared to spend the rest of their lives helping you pay off your legal bills?

Are they prepared for the loss of your income should you happen to spend the rest of your life in jail or be crippled while trying to assist somebody?

Is your employer prepared to deal with the time you're going to be spending in court possibly in and out of jail? Are they just going to hold your job for you?
Desides not everything requires shooting someone.

100% with you on this @Belt Fed This is a moral duty that far supersedes whatever politician or enforcer of "the law" has decided was OK or not. There is such a thing as moral obligation, that's part of being a decent human being.

I hate bullies. Is tough these days to ignore any living thing in distress. But at this stage in life I’m probably out gunned and out manned just to protect myself let alone any badgered bystander, and then there’s the crowd who probably are more interested filming confrontations to post on social media rather than jumping into a fracas to help.

I have a pot to p-ss in and I’m not about to give it to a lawyer or it’s client that doesn’t.

25 thugs beating on 2 folks.
numbers are in their favor. So 911 is in order

Couple folks dragging a woman out of her car and assaulting her - carjacking - in the intersection, complete different scenario .

3 guys beating on a Police Officer on the side of the road … again .. different circumstance

Cant say what I would do until the situation presents itself

let's take your wife or daughter or significant other is out and someone is beating the living crap out of them and about to do bodily harm or even worse would you rather have someone like yourself just walk by or stop a film it to put on youtube and ignore it or someone like me that's going to stop it?
I know who I'd want if it was my wife or daughter. I don't care if it's against the law or not.

Something to think about. A buddy of mine did the exact thing and went to the rescue of a woman that was being assaulted by her boyfriend. When he confronted the male, he was also assaulted and had to defend himself. Then the woman joined in and also assaulting the good Samaritan. When the police arrived, the good Samaritan was arrested for disorderly conduct based on witness testimony on the scene. I bailed him out the next morning.

I have heard of that happening a lot. Couple fighting, good Samaritan steps in and it's two on one. Good Samaritan gets short end of the stick. Hard to judge unless you are there.

Domestics are the worst, stay away from Domestics... big difference in engaging in a random situation vs a domestic... Bobby beating on Billie jean, you step in, Billie jean jumps on your back screaming 'but he loves me' Bobby starts hitting you... nah. Call 911 for a Domestic and let the rook get beat up
